Thanks for your comment. Somehow DCA caught all of us process servers off guard and now we are helplessly waiting for February 29, 2012 when it is time to renew our licenses under their new rules.

I agree that the idiots at the DCA have no clue that they are ruining the process serving business in NYC with these regulations. The DCA will collect 10.5 million dollars in bs fines from all small businesses in NYC this fiscal year. That's a 45% increase from 2009. So have businesses in NYC become wildly unscrupulous over the last 2 years? No. The DCA has one goal- make money for the City bureaucrats to justify their department and their jobs. The fact that this is happening at all is a disgrace. The fact that it's happening in the worst economic times our city has experienced since the recession is a bigger disgrace. This must be exposed. OccupyDCA

You are right about that. McEldery is just an actor, pretending to be an incompetent, preposterous process server.

Indeed, Byron lends poor credibility to the business of process serving. I wish that the stereotype that he is promoting was rejected by the public in general, because he is not representative of process servers.

There are actually a lot of details like that to take into consideration. That is a nice point to convey up. I provide the thoughts above as basic inspiration but clearly there are questions just like the one you bring up the place the most important thing will be working in trustworthy good faith. I don?t know if greatest practices have emerged around issues like that, however I'm certain that your job is clearly identified as a good game. Each girls and boys really feel the impact of only a second’s pleasure, for the rest of their lives.

Serving process on Sundays, Saturdays and holidays is also acceptable provided that the court allows it. Certain particular cases can be served on Sundays without getting a judge's express approval. For instance, NY allows service of restraining orders (Orders of protection) on Sunday. Therefore a stakeout on Sunday for the purpose of serving an order of protection is perfectly acceptable under current CPLR.

Pretty sure the CPLR prohibits service on a Sunday. So your church stakeout idea wasn't valid service. You also can't serve a defendant on a Saturday, if Saturday is their holy day.

Byron McEldry takes things way too far and airs people's private dirty laundry that I just don't think should be legal to do so! If you would just ask if they are so-&-so, and when they say yes, just hand them the papers and then say "you've been served!" You don't need to tell them that they are a deadbeat dad or whatever you think about them. You're going to end up getting really hurt one of these days by getting into people's personal business. I know I'd be extremely upset if you were to comeat me like that!! You always say, "I don't understand why he/she got so aggressive - I didn't want that to go that far." But YOU made it go there. Your life and job would be a lot less stressful and scary if you'd just serve them the papers. Stay out of their business! There's 2 (or 3 sides to every story ... you just take the word of the plaintiff - I think that's just being ignorant!
Shame on Tru-TV for airing this show ... don't we have enough drama in life?!
